In the state of Utah it’s legal to openly carry an unloaded firearm so long as you’re not in a prohibited or restricted place. If you have a Concealed Firearm permit you can carry conceal that firearm, or carry it loaded, or both. But according to an opinion by the Attorney General, a Concealed Firearm Permit, although it allows one to carry a firearm concealed, does not compel or require that the firearm be concealed.

It’s not uncommon for law enforcement officers to be ignorant of the law. In fact, although ignorance of the law isn’t a defense for you and I, LEOs are actually incentivized to be ignorant of the law! If a LEO isn’t familiar with a law, he or she isn’t held accountable for harassing someone due to that ignorance. However, if it can be proven that they were familiar with the law, they can be in big trouble for enforcing the law incorrectly.

Such is the case with the audio-recorded incident involving an open-carrier with a permit to carry concealed in Philadelphia, PA. The audio is divided up into four segments about 15 minutes each.

Can anyone cite a city, state, or federal ordinance that limits the number of rounds of ammunition someone can own at any given time?

Neither could we, but that didn’t stop a 32 year old Haverhill, Massachusetts from being arrested after police found 10,000 rounds of ammo in his car and later confiscated an additional 20,000 rounds from his home.

Haverhill told police he intended to use the ammo (in .32, 9mm, and .22 calibers) for target practice. According to sources, police say that’s “unrealistic”.

Ironically, people around the country have been seen stockpiling ammunition which others have said (combined Obama’s ongoing war efforts) have led to a nation-wide shortage on ammunition.

This arrest brings up several points of concern, the two we’d like to underscore are:

In legal terms, how much ammunition is “too much” ammunition?

Why are police enforcing a law limiting the quantity of ammunition? A law that we haven’t found to exist.

Brian Cardall (32) of Flagstaff, Arizona died on June 9, 2009 after he had what his wife called a “psychotic breakdown”. He was “acting crazy”, stripped off his clothing, and was “directing traffic” on Highway 59 near Hurricane, Utah totally nude.

His wife called 911, advised them of his bi-polar disorder and that his medication would not take affect for another 40 minutes.

Police arrived on-scene several minutes later and deployed a taser (twice) when he was uncooperative and failed to follow orders. He died shortly thereafter.

According to Amnesty International….more than 350 Americans in the past 8 years have died after being tased.

Now the audio recordings of both the 911 call and the officer’s digital recorder have been made available, you can listen to them below.
